Biden Persists with $39B Student Loan Debt Cancellation Amid Legal Challenges

President Joe Biden has taken decisive steps towards the implementation of his administration’s ambitious initiative to cancel $39 billion in student loan debt for over 800,000 borrowers. This development follows a significant legal victory, as a lawsuit opposing the program was dismissed by Michigan District Judge Thomas Ludington on Monday.

The lawsuit, lodged against the Department of Education by the Cato Institute and the Mackinac Center for Public Policy, contended that the government’s strategy to absolve borrowers who have diligently repaid their loans over a period of 20 to 25 years was unconstitutional and in breach of the Administrative Procedure Act.

Upon assuming office, President Biden had vowed to address the challenges entrenched within the student loan system, which has long been a source of concern for hardworking families. The President, 80, affirmed this commitment in a statement released by the White House on Monday, declaring, “I’m proud that my administration is delivering on that promise and has approved over $116 billion in debt cancellation for 3.4 million Americans—no matter how many lawsuits, challenges, or obstacles have been erected by Republican elected officials or special interests.”

Education Secretary Miguel Cardona revealed the loan cancellation blueprint in July, with the intent to rectify the “mistakes and mismanagement in the student loan system that began long before I took office,” as emphasized by President Biden.

He further elaborated, noting the issues that plagued the system: “When I took office, hundreds of thousands of borrowers were not receiving accurate credit for student loan payments that were supposed to be forgiven under income-driven repayment plans, or were put on hold by loan servicers in violation of Department of Education rules. Under these schemes, borrowers will have their loan balance forgiven if they make 20 or 25 years of repayments.”

ABC News reported that notifications are set to be dispatched to approximately 804,000 qualifying borrowers, bearing the subject line, “Your student loan has been forgiven.” The communication process is projected to conclude within the forthcoming weeks.

The program itself will alleviate the entire student loan debt for approximately 614,000 borrowers, marking a significant stride toward easing the financial burdens faced by these individuals.

It’s worth noting that the program’s progression comes after a significant legal precedent was set in June when the Supreme Court rejected Biden’s endeavor to discharge hundreds of billions in federal student loan debt. The court determined that the President had exceeded his executive authority in this regard.

Reflecting on his administration’s multifaceted approach to aid borrowers, President Biden conveyed that these efforts underscore one of the “alternative” avenues chosen to provide relief to affected individuals. The resolute push for debt cancellation, despite legal challenges, reflects the administration’s commitment to addressing the long-standing issues within the student loan landscape.
